2. Delivery

We usually ship available items within 24 hours after receiving the order. By shipping, the purchase contract regarding the items you ordered comes into effect under these General Terms and Conditions. Please note that an order postcard may take 2-3 days to reach us and the postal service may take 1-3 days for delivery. If you already have a customer number, please include it with your order. Please write clearly, preferably in block letters – this helps avoid reading or transfer errors – thank you!

We generally deliver by post to your home address. Poste restante or delivery to a P.O. box is not possible. There is no minimum order value. Within Germany we charge a flat shipping fee of EUR 15 for up to 50 kg package weight; for each additional 20 kg package weight the fee increases by EUR 15. Packaging without the “Green Dot” will be taken back by us at our cost. We generally deliver on account (subject to creditworthiness).

If your order is not or only partially available, you will be notified by us.

Deliveries abroad are made only by prepayment. Please add the flat shipping fee for the respective country as indicated under shipping costs. Please note that additional customs duties may apply. Information is available from your local customs authority.

3. Backorders

If we make partial backorders within Germany, you will receive them free of shipping and packaging costs. Any postal fees, such as COD charges, will be deducted from the invoice amount! Backorders are recorded starting from a single item value of EUR 10. If the value is lower, we kindly ask you to reorder the item if needed.

4. Payment Methods – Domestic

By postal cash on delivery.
You pay the invoice amount plus a COD fee upon delivery.
For legal reasons, persons under 18 can only be supplied by COD.

5. Payment Methods – Abroad

To Austria we deliver against payment or prepayment. To other countries we deliver only by prepayment, or against payment in the following countries:

Belgium, Czech Republic, Denmark, Estonia, Finland, France, Greece, Great Britain, Hungary, Ireland, Iceland, Italy, Liechtenstein, Latvia, Luxembourg, Malta (GBY), Malta (M), Monaco, Netherlands, Norway, Portugal, Poland, Sweden, Switzerland, Slovakia, Spain.

Any bank fees are borne by the purchaser. Please note that additional customs duties may apply. Information is available from your local customs authority. For prepayment you will receive a message from us after your order with exact details of the total amount including shipping and packaging costs. Please transfer the total amount only then.

6. Retention of Title

In all cases the goods remain our property until full payment has been made.

7. Prices/Offers

Price errors and prior sale reserved. Only the prices stated in our catalog/online shop and in the current advertising in euros apply. All prices are non-binding recommended retail prices including the applicable statutory VAT plus shipping costs, which you can find in our catalog/online shop. Due to legal requirements (e.g. different VAT rates) prices in our foreign branches may differ.

8. Warranty

Your order is subject to statutory provisions; as a buyer you are entitled to subsequent performance for defective goods upon delivery, either by remedy of defects or delivery of defect-free goods, i.e. the goods will be repaired or completely replaced without problems. If disproportionately high costs would arise for the variant of subsequent performance you chose, we are entitled to reject it and opt for the other variant, provided it does not also involve disproportionately high costs. The statutory warranty period is two years from delivery of the goods to you as our customer.

9. Liability

We exclude liability for slightly negligent breaches of duty, provided these do not concern essential contractual obligations, damages from injury to life, body, or health, or guarantees, or claims under the Product Liability Act. The same applies to breaches of duty by our vicarious agents.

10. Complaints

Please make complaints where you purchased the goods – this makes processing easier, faster, and more straightforward. So if you ordered from mail order, please return the goods to mail order. If you bought something in a branch, please return it to that branch – this helps a lot.

Important: We also require the purchase receipt for processing complaints. Complaints handling or repairs can only be carried out on clean, not soiled items by our suppliers!

11. Availability

Independently of 24/7 order acceptance, we are best available at the company headquarters during core working hours: Mon–Thu from 9:30 am to 3:30 pm, Fri until 1:00 pm. Of course, we are also available before and after these hours, but flexitime allows our employees to arrange working hours flexibly.

12. Returns

For returns, please use the package label enclosed with the shipment! Please mark the reason for return on the back of the shipping invoice – this gives us the opportunity to eliminate weaknesses and improve.

13. Return Policy (Right of Return)

All vehicle-specific parts that were sourced or marked using a vehicle identification number are excluded from any right of return. All goods received that are not affected by this marking can be returned without giving reasons within 2 weeks by returning the goods. The period begins at the earliest on the day after receipt of the goods and this notice. Only for non-parcel shippable goods (e.g. bulky goods) can you also declare the return by a request for collection in text form, e.g. by letter, fax, or e-mail. Timely dispatch of the goods or the collection request is sufficient to comply with the deadline. In any case, returns are at our expense and risk.

14. Purchase Receipts

Please keep all purchase receipts. They are important as proof of purchase for complaints or in case of theft for insurance purposes. Your orders are stored with us. If you lose your order documents, please contact us by e-mail/fax/telephone. We will gladly send you a copy of your order data. Under the closed user group “Big Bike Munich” in our online shop you always have access to your invoice copies.

15. Place of Jurisdiction/Choice of Law

If you are a consumer without residence within the European Union (EU) or a business customer, our business location is the place of jurisdiction. For all claims between you and us, German law applies exclusively, unless in the case of a consumer contract this choice of law deprives you of the protection granted by the mandatory provisions of the law of the EU state in which you have your habitual residence.

Our data protection practices are in line with the Federal Data Protection Act (BDSG) and the Teleservices Data Protection Act (TDDSG).
